Our trading terms shall form part of the contract which governs the relationship between you and Secure M Pty Ltd, T/as Secure M & Complete Document Disposal.
By engaging the services of Secure M Pty Ltd, trading as Secure M & Complete Document Disposal, you agree to be legally bound by these terms and conditions. These terms serve as a legal agreement and govern the entire relationship between you and Secure M Pty Ltd, outlining the obligations, rights, and responsibilities of both parties.
It is imperative that you read, understand, and accept these terms in their entirety before using our services.
SERVICES
CASUAL/ONCE-OFF SERVICE: As advised on ordering, CASUAL SERVICE bin(s) are available for 14 days free of rental fee, from date of delivery. When the bin(s) are full, it is your responsibility to call or email Secure M – Ph: 1300 66 11 77 to organize collection, if this is not done, you will be charged a rental fee of $ 25.00 + GST per week for each bin until the bin(s) are collected by Secure M.
A minimum of 3 bags per delivery/pickup is required when ordering 25kg bags – ONLY PAPER BASED documents. Bags that are overfilled and not securely closed will not be collected.
SCHEDULED/REGULAR SERVICE: All regular service customers with EXTRA BIN(S), security bins must be returned to us within 14 days from date of delivery as rental fees apply after 14 days. Please note this service is different to your regular/scheduled or On-Call service you currently use, because you are an existing customer we will charge the same rate as your current service.
Due to reduced rates for regular exchanges, out of mutual goodwill we require the service be maintained for at least a 12-month term.
Scheduled/Regular exchange services will be charged normal rate if the customer does not allow the driver to change over the bin(s) ie. not available/ not full, we will charge for the visit either way.
ON-CALL SERVICE: For an On-Call service, security bin(s) need to be exchanged at least once every 26 weeks.
You will be invoiced for any bin(s) not exchanged within each 26-week period.
BILLING
Please note, we invoice on bin delivery, NOT on pickup.
We reserve the right to amend pricing at any time. Notice may or may not be provided.
Always include Invoice number as a reference when making EFT payments to Secure M. We do not issue statements.
Credit card payments will include a surcharge for processing fees.
In the event where your overdue account is referred to a collection agency and/or law firm, you will be liable to pay Secure M all actual costs, expenses or disbursements incurred by Secure M on a full indemnity basis as well as all unpaid outstanding invoices in relation to the collection or attempted collection of all overdue amounts.
GENERAL TERMS
BINS/ ARCHIVE BOXES/ BAGS – PAPER ONLY – Staples and paper clips bull clips are OK.
NO PLASTICS/ PLASTIC SLEEVES, NO MEDIA (CD’s, DVD’s, FLOPPY) (unless a bin has been booked specifically for media or X-rays), NO HARD DRIVES OR X-RAYS. NO wet or dangerous goods, biological waste or food is to be placed in the bin(s)/box(es) or bags.
A contamination fee of $100.00 + GST per bin/box/bag will be charged.
STOP IDENTITY THEFT, we strongly advise to keep the security bin(s) with documents in a safe/locked location while awaiting collection by Secure M. (do not leave bin(s) outside and key in lock at any time)
Due to OH&S please make sure 240ltr bin(s) are on ground level if there is no lift available on day of collection.
Missed delivery/ pickup fee will be charged at $50+GST if bin(s)/boxes/bags/other are scheduled for exchange or booked for collection and not available to be collected.
If the bin(s) are damaged or not returned for any reason, you will be charged $130.00+GST per bin. – lost padlock $25.00+GST, lost keys $25.00+GST).
We reserve the right to cancel or postpone any service, delivery, pickup or otherwise as required. We reserve the right to utilise third party agents if required.
Making driver wait: In the event that for any reason whatsoever our driver is required to wait beyond the normal ten (10) minutes to deliver or collect bin/boxes/bags/other, a waiting time fee will be charged at the rate of $30.00 + GST, per quarter hour or part thereof – charged in 15 minutes blocks, after the first ten (10) minutes.
As we remain dedicated to continuously improving the quality and efficiency of our services while reducing waste and enhancing productivity, we have established partnerships with industry peers and service providers. These collaborations allow us to tap into the resources of our partner providers and contractors, giving us the flexibility and efficiency that we couldn’t achieve on our own.
Whilst Secure M Pty Ltd shall use its reasonable endeavour to keep to any agreed delivery or collection schedule, Secure M shall not be liable for any loss or damage resulting from any failure to supply or any delay in delivery or collection, non-delivery or miss-delivery for the goods or services in whole or part to the customer howsoever occasioned and whether due to any negligence or other act, default or omission of Secure M.We will organise the order processing, pickup / delivery of bins transport of do
cuments, secure destruction services and recycling services for collected documents. We will also on request email Destruction Certificate. We routinely subcontract the delivery of these services as set out below. We will take all reasonable steps to safeguard the security of your information throughout this process. We routinely subcontract secure destruction services to our approved shredding provider(s). We require our approved shredding provider(s): maintain security standards consistent with industry practices; to maintain a secure chain of custody from delivery / collection receipt through to secure destruction and to securely shred the delivered contents; to securely shred and bale paper and then ship this securely shredded paper to paper mills and recyclers. We require that these arrangements provide genuine recycling, with at least 98% of paper documents recycled into new paper products.
We aim to provide these services within the following time frames: Pickup and deliver bin/s to clients on agreed date or within 48 hours of day of ordering from our facility. Securely shred delivered contents within 48 hours of receipt at our approved shredding provider facility.
LIABILITY AND RELEASE
To the extent permissible by law (including the Australian Consumer Law), our liability is limited. We and our contractors / partners are not liable for loss or damage arising from or caused by injury, illness or death of any person, or connected with our products or services. We and our contractors / partners disclaim all conditions and warranties other than those contained in these Terms and Conditions. The customer releases us from, and indemnifies us against, any action or claim connected with our products or services.
If we do become liable, to the extent permissible by law our liability is limited to providing a replacement or refund. If we or our contractors / partners make a payment to a customer for any reason, it is not an admission of a breach or liability.
We are not liable for any breach of these Terms and Conditions arising wholly or partly from causes beyond our control, including natural causes, acts of war or civil unrest.
If we breach any of these Terms and Conditions, our rights, immunities and limitations of liability remain in force.
We may vary these Terms and Conditions from time to time. The up to date, current version will appear on our website. Without written authorisation, no employee, servant, agent contractor / partner may make representations on our behalf about these Terms and Conditions.
If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, while preserving to the maximum extent possible the original intentions of the parties. If such modification is not possible, the relevant provision shall be severed from these Terms and Conditions. The invalidity, illegality, or unenforceability of any provision shall not affect any other provision of these Terms and Conditions, which shall remain in full force and effect.
Governing law: This Agreement and any disputes related to it are governed by the laws of the State of Victoria, Australia.
